FTC Delays ‘Red Flag Rule’ Enforcement Again

At the request of Members of Congress, the Federal Trade Commission announced it will delay enforcement of the new “Red Flags Rule” again — until June 1, 2010. This is the fourth time that the FTC has delayed enforcement of the regulations that require financial institutions and creditors to develop and implement a written identity theft prevention program to detect, prevent, and respond to patterns, practices, or specific activities that may indicate identity theft. A bill to exclude some businesses from the rule passed the U.S. House of Representatives in October and awaits action in the Senate. H.R. 3763 excludes from the meaning of “creditor” any health care practice, accounting practice, or legal practice with 20 or fewer employees.
